1ST FAME GENERAL MEMBERSHIP MEETING

The Filipino Association for Mariners’ Employment, Inc. (FAME) held a very productive virtual General Membership Meeting on 25 August 2022, tackling on pressing issues that have a huge effect to the future of Filipino seafarers and the maritime sector, including the amendment of the POEA/DMW Seabased Rules and Regulations, the European Maritime Safety Agency (EMSA) audit, the IMO Member State Audit Scheme (MSAS), and the rampant issues on ambulance chasing as some of the highlights of the general assembly.

The meeting was graced by no less than the Secretary of the newly installed Department of Migrant Workers (DMW), Ms. Susan “Toots” Ople as the guest of honor. She was joined by the DMW Undersecretary for Welfare, Hans Leo Cacdac and the Assistant Secretary for Sea-based Services, Atty. Jerome Pampolina.

As an advocate of the right of OFWs, one can easily sense the sincere concern of Secretary Ople towards Filipino seafarers. In her message, she expressed her commitment to put the maritime sector at the front and center of the Department of Migrant Workers (DMW), and to strengthen the maritime agenda for seafarers and foreign principals through constant communication and proper representation in terms of policy formulations.

Secretary Ople likewise informed the FAME membership that DMW has presented the issues of the maritime sector as well as their proposed programs to President Ferdinand “Bongbong” Marcos, Jr. during the 5th Cabinet Meeting. In pursuance to pass the EMSA audit, which poses a threat to the employment of Filipino seafarers on EU-flagged vessels, DMW vowed to enhance coordination with the Maritime Industry Authority (MARINA), Departments of Foreign Affairs (DFA), Department of Transportation (DOTr), Commission on Higher Education (CHED), and other concerned agencies to ensure the EMSA findings are corrected to comply with the STCW standards.

In efforts and commitment to help the seafarers and their families, the DMW Secretary further invited FAME and the Joint Manning Group (JMG) to partner with DMW, particularly on programs for the welfare of seafarers’ children, an advocacy that is very close to the President, in the form of educational type engagements and to create more reintegration pathways for returning seafarers to help them become financially independent, especially during their retirement years.

The proposed review of the POEA/DMW Rules and Regulations was also tackled by Secretary Ople. During the open forum, the Secretary assured that there would be separate Rules for the sea-based and land-based workers in recognition of their differences, and that the Rules will be simplified for ordinary OFWs to understand. She further stressed that they aim to complete and have the amended Rules approved by the end of the year.

The issue of ambulance chasing was likewise thoroughly discussed during the meeting where worthy measures were proposed by the FAME membership. Given its urgency, Secretary Ople proposed facilitating a joint tripartite dialogue between DMW, FAME/JMG and the Department of Labor and Employment (DOLE), which was confirmed by the Labor Secretary himself, Bienvenido “Benny” E. Laguesma. The dialogue shall involve the participation of concerned agencies such as the Department of Justice (DOJ), Integrated Bar of the Philippines (IBP), Department of Foreign Affairs (DFA), National Conciliation and Mediation Board (NCMB) and National Labor Relations Commission (NLRC) for in-depth deliberation of the widespread issue on ambulance chasing.

Other topics discussed during the meeting include the Industry Manifesto on submitted to President Marcos, Jr. as well as to the DMW, report on the ILO-POEA Forum on fair and ethical recruitment in the Philippines, the issued joint DOLE-DMW Circular No. 001-2022, JMG’s legislative wishlist submitted to the Committee on Overseas Filipino Workers, and an update on the initial comments and proposals of FAME and JMG on the SB Rules and Regulations.

The meeting was concluded with a simple tribute and presentation of plaque of appreciation to Capt. Teodoro B. Quijano in recognition of his valuable efforts and commitment as a member of FAME Board of Directors from 1990 to 2022. Capt. Quijano resigned from FAME Board in March 2022.

2021 FAME Christmas Party and Induction of Officers and BOD for 2022-2023

In few more days, 2021 will come to an end and a new chapter begins. From the insight, 2021 was just as challenging and uncertain as the year it preceded due to the COVID-19 pandemic. But if there is one thing that is apparent about 2021, and something that it taught to all of us – it is that there is hope. This is exactly the spirit the Filipino Association for Mariners’ Employment, Inc. (FAME) wanted to convey during the celebration of the FAME 2021virtual Christmas Party and Induction of its Officers and Board of Directors for 2022-2023 held on 09 December 2021 via Zoom. With the theme “A Star of Hope for 2022 and Beyond”, all FAME members sported same virtual background that shows a lantern “parol” as a symbol of unity and hope.

The year-end gathering was a celebration of the collaborative efforts and initiatives between the Association and its membership together with the government and industry partners that were being accomplished despite a very difficult year. It is also a celebration to honor the newly elected Officers and Board of Directors of FAME who will be of service for the next two years. Philippine Overseas Employment Administration (POEA) Administrator Bernard P. Olalia graced the ceremony as the inducting officer as well as guest speaker. In a brief message, Administrator Olalia congratulated the new leadership of FAME as well commended the outgoing Officers and Board of Directors for their efforts and continuous involvement to address critical issues that goes beyond COVID-19.

Outgoing FAME President Atty. Rodello B. Ortiz likewise expressed his gratitude to the membership of FAME and fellow members in the Board for the “support and teamwork” during his term. Atty. Ortiz was then presented with a Plaque of Recognition by the FAME Board for his diligent service and conscientious performance as President and member of the FAME Board especially during the time of the COVID-19 era.

Newly-elected FAME President, Capt. Gaudencio “Jess” C. Morales, on the other hand, in his introduction speech said he wholeheartedly accepts the challenge that the new Board put upon him, and also reflects on his vision and goals to continue maintaining and improving the efforts of the association to bring the industry to a higher level of stability and higher social relevance that will impact the lives of the Filipino Seafarers and the maritime sector in general. Among his initial proposed agenda include conducting an association-wide Strategic Planning Exercise which aims to review the purpose for formulation of FAME’s societal vision and to consider the creation of a committee on Crew Welfare and Reintegration in addition to the five existing FAME committees namely Membership Committee, Government Committee, Legal and Legislative Committee; Education and Training Certification and Assessment Committee and Special Projects Committee. He also encouraged the FAME membership to be part of the mentioned committees.

Then of course, a Christmas party is not complete without a song and dance.

To make the party even more exciting and special, and joining the famous Tiktok trend, FAME compiled Tiktok entries from the members in tune of some of the favourite Christmas hymns and viral songs. From simple to more creative choreographies, honestly, virtual celebration has never been so much fun. Even the new set of the FAME Board has a video presentation of their own. Talking about fellowship!

All attending-members also harmonized for a Christmas carol of the beloved Filipino classic “Pasko Na Naman”. Then there was also a video presentation that celebrates the glorious days of FAME throughout the years. It was a beautiful visual that took the members down memory lane.

The festivity concluded with raffling of prizes which include gift vouchers, Christmas baskets and appliances. Congratulations to all the raffle winners and special thanks to members who generously shared raffle items namely Intermodal Shipping, Inc., AND Crewmanagement Solutions Philippines., Inc., BW Shipping Philippines Inc., MMSPhil Maritime Services, Inc., Multinational Maritime, Inc., Phil-Crewing Maritime Services, Inc., Singa Ship Management Phils., Inc., Atty. The past two years have been really though, but the challenges during these times have given a newly profound outlook and appreciation for the seafarers as well as the employees who continue to brave the challenges of the current pandemic, even if that means risking their lives for the sake of service. It was also an opportunity for all sectors to be more collaborative and innovative in terms of ideas and efforts.

As President Ortiz stated in his inspiring message where he metaphorically cited the “star” that guided the three wise men in their journey to Jerusalem to witness the born of King Jesus, the same star “will lead us towards purposeful destination”.

On 17 November 2021, the Filipino Association for Mariners’ Employment, Inc. (FAME) hosted its 47th FAME Annual General Membership Meeting virtually via Zoom as well as the first-ever virtual election of FAME Board of Directors. Out of (118) Regular FAME Members, 71 member-LMAs, represented by the official representatives and proxies, casted their votes via electronic proceeding to elect the new FAME Board of Directors for the years 2022 to 2023.

Congressman Raymond Democrito C. Mendoza, Trade Union Congress of the Philippines (TUCP) Partylist Representative and POEA Administrator Bernard P. Olalia were the Guest of Honors and Resource Speakers for the annual general assembly.

In separate reports, both speakers discussed the devastating effect of the COVID-19 pandemic to seafarers and the maritime industry in general, as well as the efforts of the government to revive the industry which is considered as one of the remaining bright spots and key to the country’s economic recovery. Among these government responses include the prioritization of seafarers in government vaccination program, classification of seafarers as key and essential workers, providing green lane for seafarers, repatriation assistance for seafarers and enhancement of online processing systems for deployment and crew change.

Administrator Olalia said POEA have issued several circulars and advisories to extend the validity of several certificates such as OECs, seafarer’s contract, accreditation and license of principals and other certifications that are being required to seafarers either for deployment or extension of their contract while they could not disembark. He also highlighted the Agency’s future plans which include the proposal to revive the Bilateral Labour Agreement (BLA), to lobby for more Philippine Overseas Labor & Office (POLO), conduct consultations with PRVs and fishing vessels, and to train POEA personnel on the MLC 2006 to be conducted by the International Labor Organization (ILO).

Congressman Mendoza also provided a report on the Magna Carta of Seafarers which he said is now pending for deliberations at the Bicameral Committee level following approval at the Lower House and Senate, as well as the Department of Filipinos Overseas and Foreign Employment which is expected to be passed considering it is a priority bill by President Rodrigo Duterte.

During the open forum, Mr. Ericson Marquez, FAME Vice-President for External Affairs, remarked that they object to some amended provisions in the Senate version of the Magna Carta of Seafarers bill, more specifically in the definition of “seafarers” and “point of hire” and thus asked the POEA to support the Lower House version with the original definition as stated in the MLC 2006 to which Administrator Olalia affirmed that he supports the proposal to use the original definition and stated as well that POEA already sent their comments with the JMG inputs to Congress.

FAME President, Atty. Rodello B. Ortiz, in his final speech as FAME president, commended the FAME Board of Directors, which he called the “Pandemic Board” for their diligent efforts and commitment despite the ongoing health scare, as well as government and industry partners and the membership of FAME for the collaborative efforts to address the issues of the maritime industry, particularly the employability of the seafarers. 

Atty. Ortiz also presented the major initiatives of the Association for the year amid the COVID-19 pandemic. Among the notable accomplishments of FAME include discussions with various government agencies and industry stakeholders to prioritize the seafarers in vaccination programs of the government, assistance for repatriation of seafarers wherein RT-PCR testing and quarantine cost to be shouldered by the government, establishment of green lane and crew change protocols for seafarers and recognizing the same as essential and key workers, participation in various vaccination programs by MARINA and LGUs, and negotiations for procurement of COVID-19 vaccines for seafarers.

FAME likewise participated in the High Level Maritime Tripartite Dialogue by the House Committee on Overseas Workers Affairs (COWA) and the International Labor Organization (ILO) with other local and international organizations to discuss coordinated strategies and solutions to the crew change crisis and vaccination of seafarers in light of the evolving situations of the pandemic in the country. FAME was also part of the Joint Statement of the Philippine Maritime Social Partners as well as the Neptune Declaration to address crew change and other COVID-19 related concerns.

On other industry matters, FAME has submitted position/recommendations on issues regarding the 2018 amendments to the MLC 2006, deferment of increase in SSS contribution, bills on Magna Carta of Seafarers, proposed Department of Overseas Filipinos (DOFIL) and Expanded Compulsory Insurance of OFWs, revision of the Implementing Rules & Regulation to R.A.10635, draft GBR on preventive suspension and the ILO basic wage rate.

Before the start of the meeting, FAME offered a video tribute to FAME past president, Mr. Vicente F. Aldanese, Jr. (+) who passed away on 26 March 2021 where his legacy was remembered by friends and colleagues in the industry.

Ms. Josephine J. Francisco (past president) and Atty. Ortiz (incumbent president) acknowledged the valuable contributions of Mr. Aldanese, the longest-serving FAME president (16 years), and how his vision changed the maritime industry forever. Mr. Michael J. Estaniel (former president), a close friend to Mr. Aldanese, and who considers the late president as a mentor, narrated a vivid picture of Mr. Aldanese as a friend and mentor, as well as confessed his love for cars and small things like coffee, music, pets and a good laugh, which not many are familiar with. 

The tribute ceremony was joined by Mrs. Pilar Aldanese, wife of Mr. Aldanese, and son Vincent Aldanese who delivered an emotional message as an appreciation for the undying love that has been given to his father.

FAME YEAR-END VIRTUAL GENERAL MEMBERSHIP MEETING 2020

There is sort of uncertainty about the year 2020, and while it is about to conclude in days, one thing is certain- the threat of the coronavirus (COVID-19) is still far from over.

This is the statement of FAME President, Atty. Rodello B. Ortiz, during the Filipino Association for Mariners’ Employment, Inc.’s (FAME) Year-End Virtual General Membership Meeting held 15 December 2020 via Zoom, where he stressed on the challenges of the manning and shipping sector, and most especially the seafarers, during this global pandemic. Atty. Ortiz likewise highlighted the efforts of FAME and the Joint Manning Group (JMG) as the umbrella organization of major maritime associations to address the issues and problems related to COVID-19, while also speaking on the direction of FAME moving forward amid the ongoing crisis. That includes COVID-19 vaccination for seafarers. In the report of Mr. Jose Albar G. Kato, Vice-President for Internal Affairs of FAME, he said that FAME and JMG have been urging to include seafarers in the priority list of the government once the COVID-19 vaccine becomes available in the country especially if it becomes a mandatory requirement by countries of destination considering they are essential workers and frontliners in the battle against COVID-19.

The Administrator of the Maritime Industry Authority (MARINA), VAdm. Robert A. Empedrad, also suggested that among the plans of MARINA is to ensure the safety of seafarers against the COVID-19, which include their prioritization to the COVID-19 vaccine. The MARINA strategic considerations also include expediting the repatriation and employment of seafarers, and to raise competence of seafarers amidst the pandemic. Administrator Empedrad likewise cited the intervention of MARINA in the protocols involving COVID-19 such as in crafting of the Joint Circular on crew change, establishing Philippines as international crew change hub, implementation of Blended Learning, establishment of One-Stop-Shop facilities for seafarers, extension of validity of certificates, extension of the Assessment of Competency under the old and new system, and setting of online appointment and application for requirements. MARINA also met with various foreign governments and industry stakeholders to address the concerns of the Philippines’ maritime sector, and there is already a proposed collaboration with other countries to establish testing and quarantine facilities in the Philippines. The MARINA Administrator further tackled the 10-Year Maritime Industry Development Plan (MIDP) of MARINA which he said that they added a new program centered on human resource as suggested by industry stakeholders, including the JMG.

On other industry matters, Mr. Ericson M. Marquez, Vice President for External Affairs, reported the proposed working draft of JMG on the amendments to POEA SEC in line with the 2018 Amendments to MLC, 2006 which will enter into force come 26 December 2020 and the draft Resolution concerning maritime labour issues and COVID-19, as well as MARINA’s request for technical support. Mr. Kato also provided updates on the pending bill on the Magna Carta of Seafarers. Additionally, FAME Director and International Maritime Employers’ Council (IMEC) Director, Mr. Michael J. Estaniel, informed about the quarantine and testing programme of IMEC in partnership with the International Transport Workers’ Federation (ITF) and the Associated Marine Officers’ and Seamen’s Union of the Philippines (AMOSUP) to prevent or minimize the spread of the COVID-19 disease.

Despite a very challenging year, FAME recognized two new members during the meeting and thus presented membership certificates to Aegiscrew Manning Inc. and 88 Aces Maritime Services Inc.

In the spirit of the holiday season, and as a simple way of a virtual Christmas get-together, FAME treated the membership with gifts and prizes via electronic raffle. The general assembly was concluded with a heart-warming message from Ms. Rowena Dalusong-Mendoza, Vice-President of Southeast Asia Shipping Corporation.

2ND FAME VIRTUAL GENERAL MEMBERSHIP MEETING

The Filipino Association for Mariners’ Employment, Inc. (FAME) called for its second virtual General Membership Meeting via Zoom on Thursday, 20 August 2020 to tackle present issues and concerns in the local manning and shipping industry. Immediate actions and initiatives through coordination with the concerned government agencies were also discussed.

FAME President, Atty. Rodello B. Ortiz, said that FAME, through representation of the JMG, the umbrella organization of the major maritime associations in the Philippines, was consulted by various local sectors in crafting the Philippines’ protocols for repatriation of seafarers and crew change. Among the recent government issuances were: The Green Lane for Seafarers, the return of stranded repatriated seafarers to their respective provinces, and the accommodation of seafarers in sweeper flights traveling to and from Manila.

Focusing on the economic impact of the pandemic, FAME and JMG appealed to the government to allocate a supplemental budget to cover the quarantine expenses of returning seafarers. Atty. Ortiz said that OWWA has agreed to cover the cost of board and lodging and meals. OWWA will also arrange for the bookings of hotel accommodation of the returning seafarers, provided that the LMAs inform OWWA five to six days prior the seafarers’ schedule of arrival. The LMAs shall be responsible to pick up their seafarers at the airport and transfer them to their booked hotels. On special cases, LMAs can arrange the booking of their returning seafarers in OWWA partner hotels, provided that they notify OWWA at least one (1) day prior crews’ arrival, and that any cancellation made without advise to OWWA and/or the hotel shall be for the account of the LMA.

The industry also urged the government to provide flexibilities to ease the requirements for deployment and crew change and to open more seaports to conduct crew change activities. Charted or commercial flights should also be arranged to accommodate embarking and returning seafarers.

In attendance of the FAME General Assembly were Resource Speakers from the Department of Health-Bureau of Quarantine (DOH-BOQ), Maritime Industry Authority (MARINA) and Philippine Overseas Employment Agency (POEA).

Dr. Carlos Dela Reyna, Medical Officer IV of the DOH-BOQ, informed that the DOH-BOQ has issued Memorandum Circular No. 2020-25 on 12 August 2020 as supplementary guidelines to ease the transit of onsigning at the Port of Manila due to overwhelming RT-PCR Testing capacity and delayed release of the swab test results by DOH-Accredited Testing Laboratories.

Under the recent DOH-BOQ Guidelines, joining seafarers, after they have been swabbed, must stay inside their individual rooms in their quarantine facilities until their negative RT-PCR test results will be released and they be transported directly to their assigned vessels. The Licensed Port Agent (LPA), in collaboration with the Licensed Manning Agency (LMA), shall coordinate with the Quarantine Medical Officer and must submit the required documents related to health clearances prior to the issuance of the Free Pratique. If the 72-hour timeframe requirement of release of RT-PCR result will not be met with, the LMA must provide the Bureau a signed certification stating that that the onsigning seafarers maintained strict quarantine and that the LMA will take accountability for the seafarers’ compliance to the medical containment and good health. Should the crew fail to comply with containment protocols while waiting for the RT-PCR Test result, s/he will have to repeat the process of testing. In case of a positive result of the RT-PCR, the seafarer must not leave his/her room until proper coordination for extraction with the Local Government Unit, City/Municipal Health Office and Temporary Treatment and Monitoring Facility (TTMF) has been established..

Speaking of MARINA’s role in the Joint Circular on Green Lane for Seafarers, VAdm. Rene Medina, OIC Executive Director of STCW Office of MARINA, said that MARINA shall issue corresponding Special Permit for applications of operator’s to serve as Crew Transfer Vessel alongside a Registered Ship. On the request to open other ports for crew change, the OSS and DOTr haVE coordinated with the LGUs to open ports in Capinpin, Brgy. Lati, Orion, Bataan and Subic Free Port for crew change. A Memorandum of Agreement (MOA) has been signed for such purpose.

VAdm. Medina likewise mentioned that MARINA has issued MARINA Advisory No. 2020-56 extending the validity of STCW Certificates expiring in August 2020. Extension will be for Six (6) Months from the date of expiry; MARINA Advisory No. 2020-36 providesd for provisional extension on the validity of Training Course Approval and Accreditation of Assessment Centers during the Enhance Community Quarantine (ECQ) period and submission of Post-Enhanced Community Quarantine Operation Plan. MARINA has also published Advisory No. 2020-59 regarding the Guidelines on the Conduct of Training during the General Community Quarantine (GCQ), which is an addendum to MARINA Advisory No. 2020-36. The issuance includes the proposal for the conduct of Blended Learning and E-Learning for maritime centers and institutions.

Another MARINA Advisory pending approval is the extension of validity of Certificates for Serving On-Board expiring from 01 September to 31 October 2020. The Certification Division and the entire STCW Office has also devised a system that would address current certification setbacks and other concerns of seafarers during the Covid-19 situation. These mechanisms include streamlining of documentary requirements, quota system for work from home and physical duty of personnel, employment and allotment of special lane for MARINA Officers. Other systems include the continuance of a no-contact policy with swift action, the study on the use of Liaison Officers as well as on-board processing and expedite processing.

POEA’s Director Levinson Alcantara, Director IV of Pre-Employment Services discussed that the POEA has issued Governing Board Resolution (GBR) No. 10 Series of 2020 to suspend further implementation of additional escrow deposit requirement for a period of two (2) years from the effectivity of the Resolution. This is a probationary solution to assist LMAs badly affected by the pandemic. The newly-issued GBR suggests that active licensed recruitment/manning agencies which has posted additional escrow deposit prior to the effectivity of the Resolution may be allowed to withdraw the amount of additional escrow deposit in excess of One Million Pesos (Php 1,000,000.00). Only active licensed recruitment/manning agencies with no more than thirty (30) pending Recruitment Violation (RV) cases are qualified to request for the withdrawal of additional escrow deposit.

Through several dialogues with the JMG, Director Alcantara mentioned they will also be issuing another GBR on the Interim Guidelines for deployment and repatriation of Seafarers during the Covid-19 period. The proposed GBR covers the concerns on pre and post deployment guidelines and the basic wage applicability for joining and returning crew.

To address the issue raised by a Singaporean publication accusing a number of Filipino seafarers with tampered Covid certificates, POEA said they have drafted an official statement on the issue and will publish an advisory to that effect. On the request of JMG to allow temporary operations outside the registered office address of LMAs, POEA advised that the proposal was already raised to the Licensing and Regulations Division of POEA for consideration.

In the other words of the FAME President, Atty. Ortiz, FAME will never falter nor abandon anyone in the group. “We are on the same boat, and we will continue this journey until we reach a safe port”, he concluded.

1ST FAME VIRTUAL GENERAL MEMBERSHIP MEETING

The coronavirus pandemic forced more employees to work from home, and government authorities and private entities are adapting to a new remote-work scheme to operate their businesses. Indeed, online meetings and conferences suddenly became a global trend as social distancing and deterrence of public gatherings are strictly observed amid growing COVID-19 concerns.

Virtual conferencing is the new normal, Atty. Rodello B. Ortiz, President of the Filipino Association for Mariners’ Employment, Inc. (FAME) suggested during FAME’s first Membership Townhall Meeting held on 15 May 2020 via a web platform, Zoom. “This is our first virtual assembly and we expect to conduct more of this until a vaccine is being developed”, he insisted.

The COVID-19 situation is a global health crisis, but more to that, it is an economic downfall that has since put various governments and industry sectors to one of their greatest challenges in decades. In the Philippines’ Shipping and Manning sector alone, Principals/Shipowners and local manning agencies are already bearing the economic impact of the current pandemic, as some agencies are on the brink of closure while hundreds of thousands of Filipino seafarers have been losing their job. And yet, it is expected to remain in the coming months, or even years. This will pose bigger problems to Filipino seafarers and the Maritime Industry.

While the Philippine Government provided several assistance programs for both local workers and Overseas Filipino Workers (OFWs), including seafarers, FAME and the Joint Manning Group, Inc. (JMG) stressed that some of the government’s efforts are contradictory and seemingly unfavorable to the Seabased sector.

The Department of Labor and Employment (DOLE) Department Order No. 211, Series of 2020, as cited by Mr. Ericson Marquez, Vice President for External Affairs of FAME, mandates the Overseas Workers Welfare Administration (OWWA) to provide the funds for quarantine expenses including accommodation and meals of distressed and/or stranded landbased and seabased OFWs during the period of the extended community quarantine (ECQ). However, the Philippine Overseas Employment Administration (POEA) Memorandum Circular No. 9, Series of 2020 imposes the obligation to the Licensed Manning Agencies (LMAs). Just for the period of March to May 2020, the LMAs have spent around P2.8B already for the quarantine of about 17,000 stranded and repatriated seafarers.

Thus, the Philippine Seafaring and Manning Industry, led by JMG and other Professional Associations and Unions, including FAME, has made an appeal to DOLE Secretary Silvestre Bello III as well as to President Rodrigo Roa Duterte to include a separate allocation for the Seabased sector in the Supplemental Budget to Heal as One Act (Republic Act No. 11469), which is being proposed to the Congress, to cover the cost of LMAs during the two month period.

On other concerns, Mr. Jose Albar Kato, Vice President for Internal Affairs of FAME, reported that they had meetings with representatives from the Maritime Clinics & Doctors Association of the Philippines (MARCDOC) and P&I Correspondents to discuss the requirements for the Pre-Employment Medical Examination (PEME), including the option of making the COVID-19 test part of PEME. As suggested by the parties, the Department of Health (DoH) should provide for, and issue the necessary guidelines on medical requirements of seafarers prior their deployment.

In addition, Guest Speaker from the Maritime Industry Authority (MARINA), Administrator Robert Empedrad mentioned that the protocols for Crew Change was already finalized and will be issued shortly by the Department of Transportation (DOTr). He likewise confirmed that the Department of Foreign Affairs (DFA) has issued an advisory extending the validity of passports of seafarers onboard for a period of one (1) year.

Moreover, Philippine Overseas Employment Administration (POEA) Administrator Bernard Olalia, also a Guest Speaker to the event, said the Agency has issued guidelines for transactions during the ECQ. As ECQ shifts to Modified Extended Community Quarantine (MECQ), POEA has adapted procedures anew requiring manning agencies to submit their applications through online appointment. A Drop Box System is also being adapted for applications for renewal and new accreditation of Principal and request of Pre-purchased Overseas Employment Certificates (OECs), while processes for enrolment of vessels and amendment of vessel details, inclusion of Shipowner in the contract, change address of Principal, cancellation of Principal vessel and enrolment of additional positions are done through POEA’s 24/7 online system. For processing of Watchlisted Seafarers and Fishers, the manning agencies can process the documents through in-house processing, same with processing of Seafarer’s Employment Contract via POEA’s Online Processing System- Seabased (POPS-Sea).

The POEA Administrator also confirmed that manning agencies applying for renewal of their company license as well as those processing for the revalidation of their OECs will be automatically given an extension of thirty (30) days from the lifting of the MECQ, in addition to the 30-days extension provided during the period of ECQ.

POEA further advised of the Inter-Agency Task Force (IATF) Resolution No. 36 Series of 2020 and said that they will be issuing IATF passes to allow employees of LMAs to report to work. Seafarers, on the other hand, do not need to be issued with said passes since they are considered frontliners.

It is not denied that the Government is doing its best efforts to respond to the current situation. But there should be more efficiency in terms of sectoral-coordination and issuance of necessary guidelines and mandates to ensure that the Philippines remain viable and competitive on the global market.

1ST FAME GENERAL MEMBERSHIP MEETING & INDUCTION OF OFFICERS AND BOARD OF DIRECTORS FOR 2020-2021

The new Officers and Board of Directors of the Filipino Association for Mariners’ Employment, Inc. (FAME) for 2020-2021 sworn into office during the Association’s 1st General Membership Meeting for the year held on 29 January 2020 at the Ballroom II of New Coast Hotel Manila. They were formally inducted by Hon. Raymond Democrito C. Mendoza, TUCP Partylist Representative and Chairman of the Committee on Overseas Workers Affairs at the House of Representatives, who was also one of the Guest Speakers for the event.

Inducted FAME President, Atty. Rodello B. Ortiz started the meeting with a keynote message where he highlighted some of the initiatives that has already been taken by the Board and assuring as well that the new leadership will continue to look after the interest of the membership and the industry in general by finding permanent solutions to address the issues and concerns involving the manning sector. He also recognized the need to strengthen their collaborative efforts and thus called for active participation of the membership in government and industry discussions as well as to take part in various FAME committees where they can impart their expertise to help and at the same time benefit from each other. 

Inducting Officer and Guest of Honor, Hon. Raymond Democrito C. Mendoza, after inducting the new FAME leadership, took the stage to deliver a short message including updates on the proposed formation of Department of OFW bill, which he mentioned to be named Department of Filipino Overseas (DFO) and Foreign Employment under House Bill No. 5832 authored by House Speaker Alan Peter Cayetano. Rep. Mendoza insisted that he will push for the inclusion of the Undersecretary for Maritime Affairs in the new department as suggested by the FAME Board as well as to recommend in the HB No. 5832 the proposal to create a separate Overseas Labor Relation Commission (OLRC) that will handle exclusive OFW cases. The Speaker mentioned that the bill will likely pass in the subsequent month/s. He also tackled the bill on Magna Carta for Seafarers, which he said has already been approved in the 16th and 17th Congress, and invited FAME to attend the Technical Working Group discussion on the proposed bill on the 4th of February. Rep. Mendoza concluded with a commitment to pursue the interest of the manning industry and seafarers in both bills. 

POEA Deputy Administrator Jocelyn T. Sanchez also graced the membership meeting to deliver a message prepared by POEA Administrator Bernard P. Olalia, who was unable to attend due to an important appointment. In his speech, the POEA Administrator expressed his support for the new leadership as they take the helm in sustaining the advocacy and dedication of the outgoing officials. He likewise expressed his hopes for FAME and POEA to support each other in their efforts for advancing the interests, capacities and potentials of the Filipino seafarers in carving leadership roles in the global shipping industry. Also in attendance were POEA Director Levinson C. Alcantara, Director IV of the Pre-Employment Services Office, and Director Augusto B. San Diego III, OIC of Seabased Center.

On other significant matters, the Board tackled the request for POEA to exclude Filipino seafarers in the deployment ban in Iraq and Kuwait considering they are not in the same category of workers being abused as cited in the POEA issued Governing Board Resolution No. 4. The Board also insisted to make the submission of Monitoring Form as per POEA Advisory No. 02, Series of 2020 incident based rather than a regular weekly report and requested as well to reduce the coverage of high risk and warlike areas as a result of the tension involving countries in the Persian Gulf and the United States to be limited to Persian Gulf and Strait of Hormuz. There was also a recommendation to revise the format of the monitoring form to remove some items that may not be necessary and may lead to a breach under the Data Privacy Law. The requirement for Polio vaccination to international travellers including seafarers and the possible effect of the rising concern regarding the 2019 Coronavirus (2019 nCoV) to public health and global market were also discussed.  The Board also reported the initiatives of FAME through the Joint Manning Group (JMG) to help the victims of the Taal Volcano Eruption and encouraged its membership to participate in the donation drive campaign either through JMG or in their own efforts.                   

The induction ceremony and membership meeting is seen as an important avenue to celebrate renewal of commitment and to encourage continued involvement of all members. This special assembly was attended by 107 representatives and guests from 84 member-companies.

FAME ANNUAL GENERAL MEMBERSHIP MEETING & ELECTION OF BOARD OF OFFICERS FOR THE YEAR 2020-2021

The Filipino Association for Mariners’ Employment, Inc. (FAME) on 25 October 2019 culminated its 45th Annual General Membership Meeting where members also elected new set of board of directors for the year 2020 to 2021. The meeting and election was held at the Ballroom, of Diamond Hotel Philippines in Malate, Manila.

Cong. Macnell Lusotan, 2nd Representative of MARINO Partylist in Congress was present during the meeting as Guest of Honor and for the first time the membership of FAME were able to listen to the group’s platforms for the maritime industry following a triumphant 2019 elections run. The speaker said that aside from the support to the President’s vision for protection of OFWs it is their firm commitment to ensure the welfare of Filipino seafarers. On the pipeline are some bills that the Partylist have filed including the proposed Department of Overseas Filipinos Act of 2019 and the Magna Carta of Seafarers. They also committed to help develop the country’s educational system, improve the fisher’s industry as well as provide service center to assist seafarers and their families.

FAME outgoing President, Mr. Michael J. Estaniel then presented the Board’s accomplishments for 2019. In a short report, he acknowledged that the global shipping is slowly recovering from the economic crisis but still faces serious challenges. Locally, there are still regulatory issues and deadline-related concerns that have to be addressed.

Mr. Estaniel assured that the Board of FAME was very much involved in representing the Association in various government and industry undertakings which include continuous dialogue with POEA to discuss and address issues on POEA processes pertaining to the deployment of Filipino Seafarers, coordination with the National Privacy Commission (NPC) with regards to requirements on Data Privacy Act and involvement in the deliberation and Technical Working Group (TWG) Meetings on the proposed OFW Bill creating a Department of Overseas Filipinos and Magna Carta of Seafarers Bill. The Board was also active in attending MITC-OSC Meetings and House of Representatives Committee Meetings and Senate Meetings on Maritime related Bills. Aside from attending a courtesy visit called by the Panama Maritime Authority, the Group participated in industry meetings to monitor and ensure MARINA’s compliance to EMSA, IMO and SID (ILOC185) Requirements, as well as the implementation of STCW related programs like the certification for ETO and ETR and guidelines on the on-board training of Cadets.

FAME likewise took part in joint industry undertakings thru the Joint Manning Group (JMG) such as the JMG’s filing of Petition for Certiorari before the Supreme Court questioning the constitutionality of the SSS Act of 2018, conduct Wellness at Sea Training Workshop in participation with the Homer Foundation Inc., held Jobs Marino Go Job Fair thru the Seafarer Center and initiated a Donation Drive Campaign for the Victims of Earthquake in Batanes. From its generated funds from Special Projects and Events, FAME likewise donated to the WWF-Philippines.

A report of the Association’s Year-End Financial Statement was also presented by FAME Treasurer, Ms. Carmen Rebusi.

Eighty-six (86) official representatives and proxies out of the out hundred eighteen (118) regular FAME members casted their votes via electronic electoral procedure. A total of Ninety-eight (98) representatives and guests attended the meeting.

Hopes soared during the 14th Annual Inter-Manning Badminton Tournament of the Filipino Association for Mariners’ Employment, Inc. (FAME).

The high-flying showdown of maritime’s best shuttlers came into force last Saturday, 07 September 2019 with 362 challengers (181 pairs) all set for action in what is known to be the battleground for badminton enthusiasts in the maritime sector. The tournament was held at the Powersmash Badminton Center located in Makati City.

Before heading to a collision, the participating companies cheerfully battled out for a chanting game to introduce their respective groups.

A short opening program then commenced ahead of the matchups. FAME Director and Chairman of the Special Projects & Events Committee, Mr. Marlon R. Roño, led the ceremony with an opening remark. Then joining him for the ceremonial toss was FAME Vice President for Internal Affairs, Mr. Jose Albar G. Kato, together with representatives of the participating companies. Ms. Monica T. Orbe of Grieg Philippines, Inc. and Mr. Marcus Reyes of Royal Carribean Cruises Ltd.-ROHQ graced the invocation and recital of oath of sportsmanship respectively.

Throughout the day, players displayed their best efforts and refused to bow down their no retreat-no surrender spirit. It was a fun yet a tough combat for sure. But when all was said and done, few players finished with flying colors.

The tournament may have been seen as an intense on-court battle but it also embraces camaraderie and sportsmanship as well promotes wellbeing amongst the participants, which was obvious in the entire competition. On top of it was the goal to raise funds to support the projects, activities and advocacies of the Association to benefit the whole maritime industry.

The thriller ended in exhilaration and high hopes. And while some won titles, some bagged big raffle prizes including badminton apparels, appliances and a brand new smart phone as a major prize, which won by Mr. John Kevin Oflas of Trans-Global Maritime Agency, Inc.

2ND FAME GENERAL MEMBERSHIP MEETING

There have been significant developments regarding Philippines’ compliance to the European Maritime Safety Agency (EMSA).

In a report of Maritime Industry Authority’s (MARINA) Division Chief of Certification Division and Maritime Education and Training Standards Specialist (METSS), Mr. Samuel L. Batalla during the 2nd General Membership Meeting of the Filipino Association for Mariners’ Employment, Inc. (FAME) held on 22 August 2019 at Diamond Hotel Philippines in Manila, the Guest Speaker said that the European Commission’s (EC) assessment of the country’s Maritime Education, Training and Certification (METC) System has been positive so far. From the 42 deficiencies noted by EC in Philippines’ submitted Report in January 2018, it was trimmed down to just 15 in the latest submission in May 2019.

Moving forward, MARINA seeks to strengthen the Administration’s requirements for certification as well as to complete and implement necessary measures in time for the next submission of Reports and Updates in October 2019. If this impressive progress continues, with the collaborative efforts of the government and the maritime sector, it may be just a matter of time before the Philippines becomes fully compliant with the EMSA standards.

Mr. Batalla also reported on the implementation of the Seafarers’ Identity Document (SID), which he said to be a requirement for Philippines’ compliance with the International Labour Organization (ILO) Convention No. 185 to which the Philippines is a signatory and the International Maritime Organization (IMO). The SID supposedly allows Filipino seafarers to access land services without visa for purposes of shore leave and interoperability of documents for transit and transfer to join or change ship to member countries who have ratified the ILO 185 Convention.

The Philippine Overseas Employment Administration (POEA) likewise gave an update on the proposed Bill creating a Department of Overseas Filipinos as well as their latest policies/guidelines in the deployment of Seafarers. OIC Director IV of the Pre-Employment Services Office, Mr. Levinson C. Alcantara said on the first topic that several bills have been filed in both the House of Congress and Senate, including House Bills co-authored by Speaker Alan Peter Cayetano and by the Deputy Speaker Paolo Duterte. The Senate version is authored by Sen. Christopher Go. The two versions sought to consolidate and absorb the OFW services and functions of the Department of Labor and Employment (DOLE), Philippine Overseas Employment Administration (POEA), Overseas Workers Welfare Administration (OWWA), Commission on Filipinos Overseas (CFO), and the office of the Undersecretary for Migrant Workers’ Affairs (OUMWA) of the Department of Foreign Affairs (DFA). POEA declared to support Senate Bill 141 of Senator Villar which recommends for POEA to be an attached agency of the proposed department. However, POEA suggested maintaining all core powers, functions and structure of the Agency, including the Governing Board as its primary decision-making body. POEA also proposed rationalizing the staffing of the POEA in the most efficient manner.

Furthermore, the POEA is said to be in the process of revising its Standard Employment Contract for Filipino seafarers and is also participating in formulation of laws for the Magna Carta for Filipino seafarers to attune to international standards of safety and working conditions onboard. POEA will likewise launch a new scheme that will link their system to the Welfare and Employment Office (WEO) where manning agencies submit deployment reports to catch the date of disembarkation of the crew members. In aim to shorten the procedure, a 3-month pilot test for the processing of the extension of contracts on board through in-house processing will also be conducted.

On other sectoral matters, the FAME Board highlighted current issues including JMG’s petition against Social Security Act of 2018 and concerns on R.A. 11223 or the Universal Health Care Law, Joint CHED-MARINA Circular No. 01-2019 and other POEA matters, which include Extension of Contract, Shortened Contract, Reinstatement of Contract, CAEP Requirement, In-transit Entitlement (Joining and Repatriation) and the Agency’s Help Desk System.

During the meeting, FAME awarded certificate of membership to two new Regular members namely Norbulk Pacific Maritime Inc. and Zeaborn Marine Services Phils., Corp.

The 2nd FAME General Membership Meeting was attended by 111 representatives and guests coming from 74 member-companies.

13TH FAME FUN RUN

Making big difference begins at the starting line.

More than 4,500 runners from the maritime sector chose not to use or at least reduce usage of plastic bottles and other plastic-based materials during the 13th FAME “Go Marino Go! Healthy Body, Healthy Mind” Fun Run held on Saturday, 22 June 2019 in support of the “Ayoko Ng Plastik” campaign of the Fund for Nature of the Philippines (WWF) or known locally as Kabang Kalikasan ng Pilipinas which is a movement against plastic pollution that is poisoning the planet.

Joining the run were maritime stakeholders and seafarers together with their families, friends and colleagues.

The earth-friendly event held at the North Fountain, SM by the BAY in Pasay City not only did challenge the participants to help save the environment by saying NO to PLASTIC, it also inspired them to showcase their creative ways of re-using disposable plastic wastes or using alternative options.

President and CEO of the WWF-Philippines, Mr. Jose Angelito Palma stressed that plastics largely contribute to climate change while also killing maritime habitats. This is crucial for the Philippines considering that it is a major maritime nation. He then encouraged everyone to reduce, reuse or recycle plastic materials if using such is unavoidable. In support of the initiative, FAME, headed by its president, Mr. Michael J. Estaniel, donated Php100,000.00 to WWF-Philippines.

Aside from the race competition, there were games and raffling of prizes courtesy of FAME and some sponsors to add excitement to the already fun-filled occasion, which is also part of the maritime industry’s commemoration of the International Seafarers’ Day held every 25th of June.

The assembly of runners opened at 4:00 a.m. followed by a short program and warm-up exercises. Ms. Ruby Ignacio of C.F. Sharp Crew Management, Inc. offered an Invocation while Prospective Officer, Mr. June Vincent Calimpon of Marlow Navigation Phils., Inc. led the Oath of Sportsmanship. The race started at 5:00 a.m.

The cadets of Marlow Navigation Phils., Inc., Leonis Navigation Company Inc. and Multinational Maritime, Inc./MMSPhil Maritime Services, Inc./Phil-Crewing Maritime Services, Inc. likewise showcased their electrifying dance grooves for a special presentation to uplift the crowd.

Vice President for Internal Affairs, Mr. Jose Albar G. Kato and FAME Director and Chairman of the FAME Special Projects & Events Committee, Mr. Marlon R. Roño together with Capt. Teodoro B. Quijano, Capt. Reynaldo D. Casareo and Capt. Emmanuel L. Regio were also in attendance to grace the ceremony.

While this is a run for fun activity, some runners deserve to be acknowledged. They worked hard to claim their glory.

15TH FAME INVITATIONAL GOLF TOURNAMENT

The Filipino Association for Mariners’ Employment, Inc. (FAME) on Thursday, 11 April 2019 celebrated milestone anew by hosting its 15th FAME Golf Invitational Tournament, which was held at the Wack Wack Golf & Country Club in Shaw Boulevard, Mandaluyong City.

For 15 years, the annual FAME Golf Tournament has been the home for golf enthusiasts and partners in the maritime sector to network, celebrate, and play for a fund-raising event to support the worthy projects and advocacies of the Association for the welfare of the whole industry. Part of the proceeds of this activity will be donated to the Fund for Nature of the Philippines (WWF) or known locally as Kabang Kalikasan ng Pilipinas.

A total of 95 registered players representing 51 organizations including some directors of FAME and partner company representatives played in this year’s tournament. Mr. Marlon R. Roño, Director and Chairman of the Special Projects & Events Committee of FAME, together with Atty. Rodello B. Ortiz, FAME Board Secretary, Atty. Jose Paolo Enrique A. Magpale, Senior Vice-President of BDO Unibank Inc. (Over-All Sponsor) and Mr. Peter McSweeney of Travel Cue Management, Inc. (Luncheon Sponsor), led the ceremonial tee off to commence the tournament at 8:00 a.m.

The extreme heat brought by the dry season was quite a challenge for the players but this was no match to the overwhelming excitement that took over once the first drive hits the fairway. Indeed, some players were on fire to rule the momentum.  

Capt. Jones T. Tulod of TSM Shipping (Phils.), Inc. proved he was a force to be reckoned with after winning back-to-back Low Gross title, while Mr. Fernando C. Zaldarriaga of BDO Unibank, Inc. ignited his game to win the Low Net award.

For the Men’s Division, Mr. Ronald Austria of C.F. Sharp Crew Management, Inc. edged Mr. Abiel S. Bugas of Ventis Maritime Corporation (1st Runner-up) and Mr. Ralph Vincent A. Pobre of C.S.C. Manila, Inc. (2nd Runner-up) to claim the top honour in the Class A category. Young and promising, Mr. Kenn Xylon S. Aquino of Great Seas Mariners Training and Assessment Center, Inc. prevailed in the Class B category, while Mr. Jhun Yparraguirre of Consolidated Training Systems, Inc. and Mr. Vicente Raymundo P. Brillantes of Intermodal Shipping Inc. finished as honourable mentions. In the Class C category, Mr. Anthony Suntay of Philippine Transmarine Carriers, Inc. clings for the lead to beat Runner-ups Mr. Martial Lawrence L. Francia of C.F. Sharp Crew Management, Inc. and Mr. Efren L. Robles of ASP Crew Management Services, Inc. C/E Nestor G. Alilin of Maine Marine Phils., Inc. was the top winner in the Class D category followed by Mr. Ernesto Galang of MMSPhil Maritime Services, Inc. and Mr. Eduardo Cabanatan of Consolidated Training Systems, Inc. as 1st and 2nd Runner-ups respectively.

Reigning back-to-back Champion, Ms. Connie C. Mamaril of Philippine Marine Travel Agents Association (PMTAA) proved she is still the queen following her latest feat in the Ladies Division. Ms. Carmen B. Rebusi of IMS Philippines Maritime Corp. came in close second and Atty. Carmela Magpantay of C.F. Sharp Crew Management, Inc. rounded up the third spot.

The battle in the Seniors Division was just as thrilling. Mr. Januario Lansang of the Maritime Academy of Asia and the Pacific (MAAP) topped fellow rivals to win the competition.  Atty. Augusto Y. Arreza, Jr. of Filipino Shipowners Association (FSA) won 1st Runner-up and Mr. Vicente A. Pono of Magsaysay MOL Ship Management, Inc. secured the final position.

The gripping contest continued in the Sponsors Division as Mr. Jose Paolo Enrique A. Magpale of BDO Unibank, Inc. put on a display to stay on top of the game. Mr. Louie Martin Inoncillo of Associated Marine Officers’ and Seamen’s Union of the Philippines (AMOSUP) and Mr. Peter McSweeney of Travel Cue Management, Inc. settled for the second and third spot respectively.

In addition to the 18-holes tournament play, participants enjoyed a variety of side competitions including Ryder Cup, 2 on 2 Putts, and Fun Hole games of which Mr. Ronald Austria of C.F. 1ST FAME GENERAL MEMBERSHIP MEETING

It is critical for the Philippines to remain part of the International Maritime Organization (IMO) “whitelist” of countries that comply with the STCW Convention 1978, the international standards of training, certification and watchkeeping for seafarers, considering that it is a capital nation of seafarers. Thus, when a recent publication cited that the country is no longer included in the so-called “whitelist” this has raised serious concerns within the maritime industry.

During the General Membership Meeting of the Filipino Association for Mariners’ Employment, Inc. (FAME) held on 03 April 2019 at the Le Salon, AG New World Manila Bay Hotel in Manila, the newly appointed Officer-in-Charge (OIC)-Administrator of the Maritime Industry Authority (MARINA), Vice-Admiral Narciso A. Vingson Jr. dismissed any truth to the published article and assured that that the Philippines is still in the IMO “whitelist”. The information was based on MSC/Circ. 1163/Rev.11 and MSC/Circ. 1164/Rev.20 issued December 2018 which contains the existing list. He said that the Philippines became a Party to the STCW Convention by way of accession and shall remain part of it as long as they continuously comply with the required standards of IMO and the said Convention.

Mr. Jonrey N. Calderon, OIC and RDD of the STCW Office of MARINA, also reported that MARINA and the STCW Office has already developed training standards pursuant to Regulation I/6 of the STCW Convention, which requires all certification, education, assessment of competence including medical certification of seafarers to be structured and documented in written programs supported by methods and media delivery as well as qualified persons. The new standards for these training courses are issued under STCW Circular No. 2018-02.  All in all, MARINA has already developed 34 mandatory full courses that would lead to certification. Out of these, 22 are newly developed courses.

It was informed also that the Human Element and Training in Watchkeeping (HTW), one of the Sub-Committees under the Maritime Safety Committee (MSC) of the IMO will be meeting on April 29, 2019 to May 3, 2019 to discuss relevant matters including the HTW 6 Agenda Item 12. Pursuant to this, MARINA met with the Secretary of the Department of Transportation (DOTr) to impose or identify actions relative to the matter to ensure that the Philippines will maintain its obligation under the Convention. The industry’s position will be carried out by MARINA during the HTW Session being part of the delegation of the Philippine government.

MARINA as well discussed their recent Integrated Seafarer Management Online System (MISMO) stressing that the new concept shall require authorized agencies including the manning companies, the training institutions, assessment centers and medical clinics to submit the documentary requirements of the seafarers directly to the MARINA database system instead of the seafarers doing it themselves. Upon completion and verification of the documentary requirements, MARINA shall issue the corresponding COP or COC of the seafarer.

Among the equally significant topics presented by the FAME Board included updates on R.A. 11199 or the Social Security Act of 2018, Open Letter to the President concerning Maritime Ambulance Chasers, report by the International Group of P&I Clubs (IG) on the number of legal cases overturned or favorably modified by the Court of Appeals and/or Supreme Court and the corresponding amount due back to Employers which stands at USD$30.5M (as of 30th Sept 2018) and lastly on Amicus Brief which was requested from the Joint Manning Group (JMG).

FAME as well awarded certificate of membership to two (2) new Regular members namely Phil-Crewing Maritime Services Inc. and KJCM Maritime Corporation.

The meeting concluded with a pledge of support to ANGKLA Partylist for the upcoming 2019 National Elections. 127 FAME representatives and guests coming from 91 member-companies attended the gathering.

ANNUAL FAME GENERAL MEMBERSHIP ASSEMBLY AND YEAR-END GET-TOGETHER

The Filipino Association for Mariners’ Employment, Inc. (FAME) held its Annual General Membership Assembly on 05 December 2018 as a concluding meeting for the year. The meeting, which was hosted at the Taft Ballroom, Conrad Manila, Seaside Blvd. corner Coral Way, Mall of Asia Complex, Pasay City, also served as a year-end get together for FAME’s general membership. Guest of Honors and Speakers of the event were Philippine Overseas Employment Administration (POEA) Administrator Bernard P. Olalia and Congressman Jesulito A. Manalo, Representative of ANGKLA Partylist.

Administrator Olalia acknowledged FAME for generating decent deployment which continues to drive the culture of manning agencies towards excellence as well as its contributions to crafting new standards for the amended 2016 POEA Rules of Seabased Sector. While the industry is experiencing challenges, the POEA Administrator believes that through unity of all sectors involved they will continue to brave the onslaught of challenges that the global industry has to endure and that brighter horizons are at hand. He then said that POEA is moving towards an innovative approach on their processing through the launching of the Seabased e-Contract System (SBECS) which features the e-Registration of seafarers, contract processing of manning agencies and data capturing of seafaring deployment, which includes relevant information of seafarers. The new system hence creates an opportunity for richer data generation that can be analyzed towards working form, policy making and streamline, convenient and secure system for both the agencies and the seafarers. The SBECS also feature a My-POEA dashboard which allows the agency to view anytime the status of their Request for Processing (RFPs), the list of their accredited principals and vessels, crew orders, processed contracts, deployment contracts and the list of documented seafarers. Aside from RFPs, agencies can also receive notifications on the status of their license such as renewal of license and inspection reports. Lastly, the Administrator urged to “continue crafting solutions together and making enabling environments so that a delicate balance between a decent work as seafaring and the prospects to better the industry is sustained even that the next industrial revolution that is ushered by technology is on the horizon”.

On the other hand, ANGKLA Partylist Representative, Congressman Jesulito A. Manalo, appealed to the membership of FAME to support ANGKLA Partylist in the upcoming election to maintain the maritime sector’s representation in the Senate. ANGKLA Partylist secured a seat in Senate in 2013 and this is the first time that “seafarers” are given representation in the Philippine Constitution. “To have a word seafarer in the Constitution means a lot because from a single word will come a policy, then legislation, then budget, and from all of these things we can direct our history ensuring that we will be part of the discussion of the National Agenda”, Congressman Manalo said.

Members of FAME consisting of 105 attendees from 73 out of 125 regular and associate member-companies attended the meeting to constitute a quorum. A simple Christmas celebration through raffling of exciting prizes concluded the year-end get together.

2ND FAME GENERAL MEMBERSHIP MEETING

A man of few words, and a man of action- This is how the Filipino Association for Mariners’ Employment, Inc. (FAME) introduced the newly-appointed Administrator of the Maritime Industry Authority (MARINA), Rey Leonardo B. Guerrero, during its 2nd General Membership Meeting held last 03 October 2018 at the AG New World Manila Bay Hotel in Malate Manila. The former Chief of Staff of the Armed Forces of the Philippines and now MARINA Administrator was the speaker and guest of honor of the forum.

In a short dialogue, Administrator Guerrero affirmed his commitment to transform the country into a major maritime nation while also recognizing that they need to improve their internal processes as well as enhance their organizational deficiencies and implement long-term industry development plans to accomplish the mission.

He highlighted that MARINA has started implementing programs to improve its services by incorporating various media platforms and developing online facility for processing and issuing of Seaman’s Identification and Record Book (SIRB), scheduling of theoretical examinations and making payments through authorized agencies and payment centers. MARINA, likewise, conducted a policy review that is set to retain 311 updated circulars and reissue 138 updated circulars upon the approval of the MARINA Board. The review of MARINA’s current organizational set-up reveals the need to embark into a comprehensive modernization program, including a proposal for the creation of offices with corresponding Plantilla positions for technical personnel.

Admin Guerrero stressed that MARINA went all out in addressing the findings of the European Commission (EC) pertaining to the European Maritime Safety Agency’s (EMSA) audit by implementing corrective measures which MARINA completed and submitted on 13 September 2018 through the Ambassador of EU Mission to the Philippines. Included in the implementing actions taken by MARINA were revisions of several circulars to harmonize with the provisions of the STCW Convention Manila Amendments and upgrading of training standards for refresher courses in Advanced Firefighting and mandatory training courses for passenger ships and electro-technical officers. MARINA has also developed comprehensive internal processes in accordance to its Quality Management System to be able to appropriately evaluate and monitor the Maritime Education and Training Institutions (METIs) and Maritime Higher Education Institutions (MHEIs).  To ensure the sustainability of these corrective measures, MARINA and the Commission on Higher Education (CHED) signed a joint memorandum on 10 July 2018 to strengthen the authority of MARINA, through the STCW office, which is the duly established Single Maritime Administration. President Rodrigo Duterte, as well, issued Executive Order No. 63 Series of 2018 strengthening MARINA’s administrative power over and International Convention on Standards of Training Certification and Watchkeeping (STCW) for Seafarers, as amended. The issuance shall harmonize the STCW implementation between MARINA, CHED, DOH and PCG. This shall also assign the reconstitution of the Technical Panel for Maritime Education (TPME).

With remarkable accomplishments and exemplary honors in his 38 years of military service, the membership of FAME and the entire industry is hopeful that the new chief of MARINA will continue his dedication and commitment in his new field to finally accomplish the long-time clamour of the maritime sector.

Also present during the meeting were Deputy Administrator for Planning and Executive Director for STCW, VAdm. Narciso A. Vingson Jr., and Mr. Jonrey N. Calderon of the STCW Office. The latter presented a detailed report of MARINA’s compliance to the EMSA findings.

Other industry concerns tackled includes the National Maritime Industry Development Agenda, crewing issues, DFA 1OFW Portal, Issuance of SIRB to foreign students and Data Privacy Act of 2012.

FAME encouraged its membership to participate in a signature campaign to support the manifesto condemning ambulance chasing as a cancer afflicting the maritime industry. The manifesto calls for attention to declare an urgent need for the Philippine Government to initiate reforms and long-term solutions that will finally put an end to the proliferation of usurious ambulance chasers as it has become a pressing reason for international shipowners to abandon their enterprise in the Philippines.

The 2nd FAME General Membership Meeting was attended by 126 attendees representing 84 of the 127 FAME member-companies.

13TH FAME INTER-MANNING BADMINTON TOURNAMENT

The Filipino Association for Mariners’ Employment, Inc. (FAME) unfolded its 13th Annual Inter-Manning Badminton Tournament on Saturday, 08 September 2018, with big goals from returning podium finishers as well as aspiring new entrants joining the biggest platform for badminton enthusiasts in the maritime industry. The PowerSmash Badminton Center in Pasong Tamo, Makati City was a home to the one-day tournament, which gathered 352 players (176 pairs) from 28 companies competing in the Men’s, Ladies and Mixed Doubles divisions.

A short opening program commenced ahead of the tournament matchups. FAME President, Mr. Michael J. Estaniel graced the event for an opening remark while FAME Vice President for Internal Affairs, Mr. Jose Albar G. Kato, joined him together with representatives of the participating companies for the ceremonial toss. Ms. Shiela May S. Fontelo of K-LNG Maritime Services, Inc./Ventis Maritime Corporation and Ms. Jeanna Rose Magdayo of Pacific Ocean Manning Inc. led the invocation and oath of sportsmanship respectively.

The competition delivered action-packed games, but at the end of the day only few were able to claim the crown. Here are the winners who stepped up to the challenge and proved to be the best in their respective categories.

HOW TO JUMPSTART YOUR COMPLIANCE TO THE DATA PRIVACY ACT: A FAME WORKSHOP SERIES

The Filipino Association for Mariners’ Employment, Inc. (FAME) in partnership with Madworks, conducted two Workshop Series entitled “How to Jumpstart your Compliance to the Data Privacy Act (DPA)” to further assist the manning companies to comply with the requirements of the DPA. The three-day session workshop series involved the participants into in-depth practical and interactive activities that shall empower them to conduct their own privacy impact assessmens as well create privacy policies and breach management response procedures as required for the DPA compliance.

Moreover, performing these key DPA activities assures the compliance of the participating companies to the International Privacy Laws, specifically the EU GDPR and the Japan APPI which took effect May 25, 2018 and May 31, 2018 respectively.

Imparting their expertise as speakers and facilitators were Mr. Roy Celeste T. Marzan, Principal Consultant of Cosaint Consulting and a DPO of four companies, Ernest Richard G. Ocson, Data Protection Officer (DPO) of Incuventure Partners Corporation and Atty. Karl John A. Baquiran, a former member of the Compliance and Monitoring Division of NPC. FAME Vice President for Internal Affairs, Mr. Jose Albar G. Kato, was the moderator of the event.

The first batch of the workshop series was held on July 24, 30 and August 06 2018 and the second set was conducted on September 17, October 1 & 8, 2018 at the AMOSUP Convention Hall in Intramuros Manila. A total of 73 attendees representing 42 manning agencies attended the workshop seminar.

Certificate of participations were provided to all participants who completed the three (3)-Part Workshop Series. Such certification already forms part of the compliance requirement as per DPA IRR Section 26-D.

DPO17: DATA PRIVACY FOR THE MARITIME SECTOR

When the Data Protection Act (DPA) of 2012 took effect in September 2016, the appointment of a data privacy officer became mandatory for any organization that processes or stores large amounts of personal data.

Following a highly-attended info-series that tackled key concepts and compliance points of the DPA, the Filipino Association for Mariners’ for Employment, Inc. (FAME) together with the Joint Manning Group (JMG) collaborated with the National Privacy Commission (NPC) to convene a major Summit dubbed as “DPO17: Data Privacy for the Maritime Sector” for Data Protection Officers (DPOs) of manning companies. This aimed to inform DPOs to fully understand their responsibility and accountability. The event was held July 12, 2018 at the Amosup Convention Hall in Intramuros, Manila.

Privacy Commissioner and Chairman Raymund Enriquez Liboro emphasized the importance of having a systematic compliance with data privacy and protection as a competitive edge in today’s information age where “data becomes the new oil of the digital economy”. He said the law has to be resilient in order to cope with rising risk factors of this 21st Century, especially because technology and modernization continue to evolve. It is the role of the DPOs to ensure that their organizations are in constant state of operational compliance.

 Administrator Rey Leonardo B. Guerrero of the Maritime Industry Authority (MARINA) in his message read by Director Efren Juan B. Borci acknowledged challenges in the Maritime Industry Sector amid increasing popularity of technology advancements. “Application systems are being developed for each agency to create a systematic gathering of information. This, however, increases instability, therefore, measures to control and safeguard the vast information that is in our hands is very necessary.” Continuous mechanisms should be developed to avoid unauthorized access, theft or loss of personal data.

Other NPC speakers outlined topics on the Overview of the DPA law. These were Deputy Privacy Commissioner Atty. Leandro Y. Aguirre, Data Breach Management and Security Incident Reporting by Atty. Vida G. Bocar of the Complaints and Investigation Division. A report on Global Data Protection Regulation (GDPR) and its similarities with the DPA was presented by Atty. Jeff E. Datingaling, OIC of the NPC Enforcement Division.

Opening Remarks and Keynote Message on the Maritime Industry were FAME President Mr. Michael J. Estaniel and JMG Chairman Capt. Oscar Orbeta while FAME Director Mr. Jose Albar G. Kato served as the moderator during the event.

This assembly also functioned as the first move of collaboration with NPC in developing a program to address the distinct concerns of the manning sector regarding data protection and privacy. It also aimed to create an industry standard on data compliance. 243 attendees representing 122 manning agencies and stakeholders across the maritime sector were present.

12TH FAME FUN RUN

The largest fund-raising event in the maritime industry pedalled on Saturday, 23 June 2018 with a bigger 12th FAME “Go Marino Go! Healthy Body, Healthy Mind” Fun Run hosting over 4,600 registered participants -a record-breaking for the occasion, which was part of the Maritime Industry Authority’s (MARINA) celebration of the International Day of Seafarers which is held every 25th of June.

Despite a rainy Saturday forecast, the overwhelming crowd were greeted by a surprising fair and sunny whether except for a downpour of excitement that was even made thunderous by chants and tramps of runners approaching the finish line at the North Fountain of SM by the BAY. There were also side games and raffling of fabulous prizes such as Smart TV, mobile phones courtesy of SM Communications, Inc, cash prizes, gift certificates, running accessories, gadgets and appliances which made the competition more fun and exciting.

Speaking of fun, the cadets of Leonis Navigation, Inc. had a special presentation which by the way was wonderful and definitely uplifting. Great job guys!

The assembly of runners opened at 4:00 a.m. and the race started at 5:00 a.m. immediately after a short program and warm-up exercises. Special thanks to Ms. Ivy S. Flores of Wallem Maritime Services, Inc. and Mr. Giancarlo Dabao of OSM Maritime Group for rendering the Invocation and Oath of Sportsmanship respectively, and to some members of the FAME Board of Directors including FAME President, Mr. Michael J. Estaniel, Vice President for Internal Affairs, Mr. Jose Albar G. Kato, and FAME Director and Chairman of the FAME Special Projects & Events Committee, Mr. Marlon R. Roño for gracing the ceremony. Some members of the FAME Board of Directors also joined and completed the race. Congratulations to Capt. Teodoro B. Quijano, Capt. Reynaldo D. Casareo, Capt. Emmanuel L. Regio and Ms. Carmen Rebusi. The proceeds of the event will be allocated to a proposed research project to pursue the maritime agenda of the Association and the industry as a whole as well as to promote greater awareness of Seafaring as a career.

1ST FAME GENERAL MEMBERSHIP MEETING

Representatives from the Philippine Overseas Employment Administration (POEA) including Director Yolanda E. Paragua, OIC, Director IV of Pre-Employment Services Office, Mr. John Rio A. Bautista, OIC, Legal Research of Docket and Enforcement Branch and Director Ramona S. Quijano, Director II of ICT Branch graced the first General Membership Meeting of the Filipino Association for Mariners’ Employment, Inc. (FAME).  The meeting was held at the AG New World Manila Bay Hotel, Malate Manila on May 09, 2018 to address important industry concerns amid implementation of POEA’s new procedure for online registration and Seabased E-Contract System (SBECS).

Director Paragua discussed that SBECS is an upgrade to the e-Sub developed to make the processing of Overseas Employment Certificate (OEC) as well as payment for POEA processing and OWWA membership fees faster and more accessible. The e-Registration provides for new unique registration number that will link the seafarer’s profile to the SBECS such that in requesting for processing of the seafarer’s contract, the agency will just key-in the registration number of the seafarers in the SBECS and the required information of the seafarers will automatically be displayed. When this is done, the seafarers will receive notification of the status of their contract processing and may now view and print their contracts information through their MyPOEA Dashboard under the e-registration System. Still in its early stages, POEA admitted that there are still glitches in the system and they asked for a few more weeks to correct the problems. POEA likewise confirmed that there are expansions being made on online services including electronic submission of accreditation documents of employers/principals. Director Paragua also stressed that they are currently conducting review of the Standard Employment Contract (SEC) for seafarers incorporating the requirements and amendments of MLC 2006. They are also in the process to develop a separate SEC for fishers which includes their basic wages and benefits.

The meeting’s agenda included matters on the IBF Framework Agreement for the year 2019-2022, Data Privacy Act compliance, Panama online verification of medical certificates, update on the EMSA Audit, Substitute Bill on DMD/DOFW Bills, and MARINA and OWWA updates. Capt. Emmanuel L. Regio, FAME Director and member of the OWWA Board of Trustees, informed that OWWA is planning to revive and upgrade their programs and services to provide more assistance to seafarers and their families and therefore encouraged the FAME members to submit their proposals as well take the opportunity to avail of these programs.   

During the meeting, FAME awarded certificate of membership to six (6) Regular members namely Admiman Manning Inc., Crossworld Marine Services, Inc., Epsilon Maritime Services, Inc., Marlow Navigation Phils. Inc., RCCL Crew Management, Inc., Wagenborg Manila, Inc., and two (2) Associate members namely Asian Institute of Maritime Studies (AIMS) and International Registries (Far East) Limited Representative Office-Manila.

The meeting was attended by 144 FAME representatives and guests from 88 companies, all expecting that POEA would live-up to their commitment of providing better services and protection to Filipino seafarers.

14TH FAME ANNUAL GOLF INVITATIONAL TOURNAMENT

Friday, 13 April 2018, already approaching the weekend, the Filipino Association for Mariners’ Employment, Inc. (FAME) had the perfect treat for golf enthusiasts in the maritime industry as it staged its 14th FAME Annual Golf Invitational Tournament at the country’s premier golf avenue, the Wack Wack Golf & Country Club located in Mandaluyong City. Upon arrival, participants were already delighted with complimentary registration giveaways from FAME and the sponsors.

It didn’t take long before the quiet scenery of the famous golf course to turn into a battleground for the 93 registered players of the competition. At 8:00 a.m. FAME President, Mr. Michael J. Estaniel, together with Capt. Emmanuel L. Regio, FAME Director, and Over-all Sponsor representatives, Mr. Edwin G. Reyes, EVP and Head of Transaction Banking Group of BDO Unibank, Inc. and Mr. Ferdinand C. Bacungan, FVP and Head of Remittance Business Development of BDO Unibank, Inc. graced the ceremonial tee off to hint the start of the tournament.

Throughout the day the players tried to keep their cool amid playing under the pressure of the summer sun but Capt. Jones T. Tulod of TSM Shipping (Phils.), Inc. outshined the heat to win the Low Gross Over-all Champion. Aside from trophy, he was awarded with a round trip ticket to Singapore with two (2) nights accommodation and eligible to play in the Travel Cue Invitational Golf Tournament in Singapore. Another big winner was Commo. Honorio B. Casalme of Philippine Transmarine Carriers, Inc. who won the Low Net award. An array of activities like ryder cup competition, 2 on 2 putts, nearest to the pin as well as longest drive and most accurate drive challenges were included to add thrill to the contest.

The day of golf was concluded with awarding ceremony and a banquet to get the players fuelled after an exhausting display at the greens, which was sponsored by Travel Cue Management, Inc. New Hall of FAMErs were likewise inducted during the program as well as raffling of prizes.

FAME INFO-SERIES ON UNDERSTANDING THE TRAIN LAW

2018 marked a new track for the Philippines’ tax system as it gets comprehensive modification through Tax Reform for Acceleration and Inclusion (TRAIN) law; the new law has been effective since January 2018 following its publication in the Official Gazette on 27 December 2017.

Riding with the new TRAIN, the Filipino Association for Mariners’ Employment, Inc. (FAME) conducted an Info Series last Tuesday, 20 March 2018 for the manning agencies to have a better perception of the redesigned tax system and its possible effect to the shipping and manning business.

The goal of the first package of the Comprehensive Tax Reform Program (CTRP) or TRAIN is to create a simpler, fairer, and more efficient tax collection where the rich will have a bigger contribution and the poor will benefit more by paying less. Thus, all taxpayers except the richest will have a lower personal income tax under the reform. Those with annual taxable income below P250,000 are now exempt from paying tax, while the rest, except the top individual taxpayers with annual income exceeding P8 M, will likewise observe lower tax rates and may opt to pay a simpler flat tax rate of 8%.

While the tax reform is seen to lower and simplify personal income taxes (PIT) thereby boosting the take home pay of most individuals it must be noted that the reduction of PIT will mean a higher value-added tax (VAT) as its barter excise tax on oil and petroleum, automobiles, cosmetics, mineral, tobacco, financial taxes, and sugar-sweetened beverages will be added/raised and this will be the driver to raise resources needed for funding infrastructure and social services programs including education and healthcare services. These are parts of the government’s program to eradicate extreme poverty and sustain high and inclusive growth.

The speaker of the forum was Atty. Fabian K. Delos Santos, partner of SGV & Co. He premised that the TRAIN serves as the vehicle "to cross from where we are now to where we want to be;" and while it is something hoped to be achieved, he is positive that the TRAIN law will be the medium whereby the objectives of the Duterte administration will be reached.

FAME INFO-SERIES ON DATA PRIVACY ACT

In 2012, the Philippine Congress passed Republic Act No. 10173, also known as the Data Privacy Act (DPA) of 2012, to provide necessary and imperative precautions to critical concerns involving human right of privacy and communication which are more apparent in this evolving world of modernization. Its roots are from the United Nations Universal Declaration of Human Rights 1948. Subsequently, the DPA’s Implementing Rules and Regulations (IRR) took effect on 09 September 2016, thus mandating all companies to comply.

In attendance were recognized authorities in the field of data privacy, the Filipino Association for Mariners’ Employment, Inc. (FAME) conducted an Info-Series on 07 February 2018 at the AMOSUP Convention Hall in Intramuros Manila in aim of familiarizing manning agencies to key concepts and compliance points of the Data Privacy Act and its Implementing Rules and Regulations as well as to assess practical implications and application of the law to their business operations. Spearheaded by speakers from the National Privacy Commission (NPC), Atty. Vida Bocar, Attorney IV of NPC’s Compliance and Monitoring Division, and Incuventure Partners Corporation, Mr. Dave John A. Macias, CEO, & Mr. Ernest Richard G. Ocson, Data Protection Officer (DPO), the forum gave a perspective on how   participating companies should prepare in order to align with the new law as countdown to compliance approaches.

Incidentally, NPC had a September 9, 2017 deadline for registration of appointed Data Protection Officer (DPO) and a March 8, 2018 for registration of processing systems, but NPC said that they will still accept late registration. The privacy body likewise mentioned to be conducting inspections and those who have not registered their DPOs yet are among their priorities.

Compliance is not a one-time activity. It is continuous improvement and as technologies develop so must data protection. No one and nothing is safe especially with today’s digital shifts. The road to compliance is a start for change.

FAME ANNUAL GENERAL MEMBERSHIP MEETING AND ELECTION OF NEW BOARD OF DIRECTORS FOR 2018-2019

FAME outgoing President, Mr. Marlon R. Roño, started his term whilst the industry was threatened by a situation in the global shipping market. Yet, other internal and external factors continue to create a strong current of challenges to this sector. But these strong currents were met with stronger will and determination forged into action, policy formation, and a concrete agenda that will propel the industry forward to what could be the strongest decade for this sector. With the legacy of great leader who is leaving behind a beacon of accomplishments and new opportunities, there is a way to successfully navigate this sea of challenges.

“It was indeed a very challenging year for all of us brought about by the downturn in the Global Shipping.  Our nation was also undergoing radical transformation and our Industry was not spared from such transformation and changes.  But with the support of all stakeholders, we remained at the forefront despite of all the challenges”, Roño remarked during the Filipino Association for Mariners’ Employment, Inc.’s (FAME) Annual General Membership Meeting and Election of new Board of Directors for 2018-2019, which was held last 22 November 2017 at the AG New World Manila Bay Hotel, Manila, stressing on the accomplishments of the association during his two-year term. Among these notable actions include the creation of a Maritime Industry Roadmap and proposal of the National Seafarers Administration which could define the path that the industry will be moving toward in the next decade. Centered on a framework to address President Rodrigo Duterte’s 10-point National-Economic Agenda, specifically on job creation, the Agenda which is entitled Maritime Roadmap for Blue Philippines aims to embody the use of the sea and its resources for sustainable development, maintaining the maritime industry as the backbone of the Philippine economy. The Industry Maritime Roadmap was also submitted as part of the Maritime Industry Authority’s (MARINA) 10-year Maritime Industry Development Program (MIDP). For the longest time, the seabased industry has been lumped together with the landbased sector in handling their government regulatory requirements. But this has proven throughout the years to be counterproductive to the seabased industry simply because of the unique and peculiar employment practices on board a ship that would not be in parallel with of the other sector. The creation of the National Seafarers Administration could finally establish the maritime sector as a totally separate entity which organize, maintain and operate exclusive adjudication and welfare office for domestic as well as overseas seafarers and fishermen to protect their welfare.

FAME likewise actively participated in the formulation and revision of government regulations and policies such as the 2016 Revised POEA Rules and Regulations and its Implementing Rules and Regulations (IRR), Implementing Rules and Regulations (IRR) of the new Overseas Workers Welfare Administration (OWWA) Act, the new Social Security System (SSS) bill, revision of MARINA Implementing Rules and Regulations (IRR) of R.A. 10635 or the MARINA STCW Administration Act of 2014, and the Magna Carta of Seafarers Bill, which has already been approved at the House of Representatives for the third and final reading. The Association also maintained harmonious relationship with industry stakeholders such as the Panama Maritime Authority and US Embassy to address the issues of its membership concerning processing of seafarers’ documents and licenses. They also conducted meetings with International Group of P&I Clubs (IG) to address legal cases lodge in NLRC and NCMB and submitted its position regarding the issues of piracy and robbery to the International Labour Organization (ILO).

Guest speakers for the event were Undersecretary Dominador R. Say of the Employment and Policy Support of Department of Labor and Employment (DOLE) and Atty. Vida Bocar, Atty IV–Compliance and Monitoring Division of the National Privacy Commission (NPC).

Usec. Say said DOLE is aware of the many impediments that need to be addressed but it should be confronted together with the industry. First of which is to make the industry more developed and at par with international standards. The industry also has to be instrumental in charting more productive and safe employment pathways for seafarers and to become more streamlined and efficient so to continue to be a prime source of ethically-recruited seafarers. Resonating on the policy thrust of President Duterte, the Speaker insisted to invest in human capital and ensure equal access to economic opportunities. Atty. Bocar, on the other hand, presented a concise orientation of the R.A. 10173 or the Data Privacy Act of 2012. FAME proposed to conduct an Info-Series to tackle the matter in detail.

With A quorum of seventy-six (76) out of the one hundred thirteen (113) regular FAME members, the election of Board of Directors was concluded and consequently followed by the election of Officers on December 06, 2017.

12TH FAME INTER-MANNING BADMINTON TOURNAMENT

Badminton players and enthusiasts representing twenty-eight companies and organizations from the maritime industry trooped to the Powersmash Badminton Center in Pasong Tamo, Makati City last Saturday, 09 September 2017, for the 12th FAME Inter-Manning Badminton Tournament. Shredding their corporate uniform for their badminton outfit, the 364 (182 pairs) registered participants proved to be tough at work but harder at play.

The intensity was inevitable from start to finish. Even a downpour cannot cool down the temperature brought by the electrifying matchups. During the opening program, the participating companies were enjoined to a cheering contest of which a three-way tie decision was awarded to Dohle Seafront Crewing Manila Inc., Michaelmar Phils., Inc. and Tri Maritime Corp.

The opening ceremony opened at 7:00 a.m. with short remarks from FAME Director, Mr. Jose Albar G. Kato while Mr. Raoul Ramos of Dohle Seafront Crewing Manila Inc. and Ms. Virginia T. Dacia of Trans-Global Maritime Agency Inc. led the Invocation and Oath of Sportsmanship respectively. Representative of each company joined in gracing the Ceremonial Toss, which is a first for the FAME annual tournament.

By the end of a thrilling day-long competition, Michaelmar Phils., Inc.’s Jerimiah John B. Bernal & John Darell Evangelista were crowned as kings in the Level A- Men’s Doubles pushing fellow group mates Athanacius N. Gallardo & Kim Dela Paz Santos in the second spot while Anne C. The maritime industry seemed to have found a new hope in addressing their issues and concerns to the government in the person of the newly appointed Undersecretary to the Human Capital Development and Regional Operations of the Department of Labor & Employment (DOLE), Bernard P. Olalia.

During the 2nd FAME General Membership Meeting held at the New World Manila Bay Hotel in Manila last 21 June 2017 wherein he was the Guest of Honor, Usec. Olalia committed to help the industry in their appeal to the agencies, specifically to the Philippine Overseas Employment Administration (POEA) and his new home Department of Labor & Employment (DOLE), insisting that both sectors must continue to strengthen their fruitful collaborations to sustain common goals for the development of the Filipino seafarers. The speaker then progressed into summarizing DOLE’s platforms for the seabased sector, which includes setting into place several policies to provide a comprehensive welfare and protection to Filipinos in the maritime industry such as in the areas of occupational safety and health, employment in Philippine registered ships that are engaged in international voyage, inspection and certification of international vessels as well as providing for support to returning seafarers and their families and piloting a training and research that responds to the needs of the Filipino seafarers.

Usec. Olalia delivered his speech brief and direct. But his short talk meant more than just words. For an industry that is going through so much just to have their voices heard, these words are sound of a promise, a new hope.

An overwhelming one hundred and fourteen (114) guests and representatives from eighty-three (83) member-companies attended the 2nd FAME general assembly, which highlighted the topics on the status of Magna Carta of Seafarers, MLC 2006 Implementation, MARINA Maritime Industry Development Program (MIDP), Panama and SSS concerns, Creation of Department of OFWs and the 2016 POEA Rules & Regulations.

Ericson M. Marquez, FAME Vice-President for External Affairs of FAME, shared that through efforts of Usec. Olalia the Joint Manning Group (JMG) was able to seek renewal of discussion with the Philippine Overseas Employment Administration (POEA) to again review their contentious provisions to the 2016 POEA Rules & Regulations. In that meeting with the seabased sector of the Maritime Industry Tripartite Council (MITC) convened last 19 June 2017, Marquez claimed that some of the provisions in the new POEA Rules for seabased were merely lifted from the landbased Rules. The principals’ financial liability on escrow is a clear case of that. Marquez insisted that an escrow is not acceptable to the industry hence they are now proposing for establishment of a separate contingency fund which could answer for financial liabilities in case their principals refuse to pay. On a basis of a draft Guidelines that the JMG has submitted to POEA, there is now a draft circular allowing the assignment of one principal’s representative in the Philippines. JMG likewise raised the concern regarding disciplinary actions suggesting consideration of a monetary fine on the first three offenses rather than imposing direct suspension to either the vessel where the crew is employed, the license of the manning company or accreditation of the principal.

The proposed creation of Department for OFW was also highlighted by Atty. Rodello B. Ortiz, and according to the FAME Secretary they are now thinking of the possibility of proposing a bill to create a separate administration for the seafarers under the Department for OFW. Once this is implemented it will be a one-stop office where all concerns of the seafarers are addressed.

Realizing the need to push for all these legislative provisions and other industry initiatives in order to protect the interest of the shipping manning companies and the employment of the Filipino seafarers, the meeting concluded with a proposal from the FAME Board to generate a contingency fund in support of a research project intended for said purpose- putting the clamour of the industry into motion.

11TH FAME FUN RUN

Running is a continuous cycle, and in every finish line begins goal anew. Inspired by vision and aspiration, the longest-running race event in the maritime industry continues its quest to set another decade milestone.

Last 17 June 2017, the Filipino Association for Mariners’ Employment, Inc. (FAME) sprinted its way to 11th FAME Fun Run - “Go Marino Go! Healthy Body, Healthy Mind” proving to be not just another trend but a long-term commitment to promote health and wellness awareness in the maritime community through this enjoyable yet competitive sport. This also marked a renewal of partnership of FAME with the World Wide Fund for Nature Philippines (WWF) to support a worthy program and advocacy relating to protection and conservation of the maritime environment.

It was a sunny and beautiful Saturday, a perfect day to take some rest or maybe a getaway yet so many people did not hesitate waking up early to join the race and pay tribute to their “heroes” as this event was also in participation to the global commemoration of the International Day of Seafarers on 25 June 2017 and Father’s Day celebration which is celebrated every third Sunday of June. The great weather brought a surging sea of faces covering the entire lane of the North Park, SM by the Bay of Mall of Asia Complex with 4,400 runners sporting blue singlets to support the FAME run for a cause advocacy. By the end of the program, FAME, joined by some of its Board members including the president, Mr. Marlon R. Roño, awarded a Php100,000.00 donation to WWF. The acceptance of the donation was graced by WWF President and CEO, Mr. Jose Angelito Palma.

Whoever may say that thirteen is unlucky number shall be proved wrong. Last 04 May 2017, the Filipino Association for Mariners’ Employment, Inc. (FAME) hosted its 13th Annual Golf Invitational Tournament at the Wack Wack Golf & Country Club in Mandaluyong City and, well, it turned out to be a certified hit, refusing to fall under the spell of what is supposedly an ominous digit that is assumed by some to bring bad luck.

Although the hole-in-one prize remained elusive in this year’s tournament, the players had their fair share of luck as some triumphed in their respective playing divisions while some got lucky to win fabulous raffle prizes.

1ST FAME GENERAL MEMBERSHIP MEETING

Hon. Hans Leo J. Cacdac made his first appearance to FAME as the new Administrator of the Overseas Workers Welfare Administration (OWWA) during the 1st FAME General Membership Meeting of the year last Thursday, 09 March 2017 at the Century Park Hotel in Manila. He was the Guest of Honor to the occasion.

“It is good to be back home” begins a smiling Cacdac while the crowd stood off their seat to welcome the newly appointed official. As a former Administrator of the Philippine Overseas Employment Administration (POEA), the now OWWA Administrator has always been part of the maritime industry- and the FAME Board did not forget to acknowledge that.

Administrator Cacdac delivered his report brief and straightforward stressing on the implementation of the Republic Act 10801 (OWWA Act), the PDOS for the Filipino Seafarers and the new programs of OWWA for the Seafaring and Maritime Industry. In summary, the Speaker reported that the IRR of the R.A 10801 has already been signed by all the OWWA Board of Trustees last 06 March 2017 and will take effect by 24 March 2017 following its publication on two newspapers of general circulation in 08 March 2017. Under the new law, the OWWA membership is now valid for two years for both land-based and sea-based workers. The Agency likewise drafted a Memorandum of Instruction on the revised guidelines of PDOS, particularly the separation of land-based and sea-based guidelines on the implementation of PDOS. OWWA will continue its implementation of the Seafarer’s Upgrading Program (SUP) as part of their programs for the Seafaring and Maritime Industry. These courses are also regularly updated in compliance with the prescribed maritime training courses of the Standards of Training, Certification and Watchkeeping (STCW) Convention. Responding to the request of the Joint Ship Manning Group (JMG), the OWWA Board of Trustees has allocated Fifty Million Pesos (Php 50 million) as financial assistance/subsidy for Marine Deck and Engine Officers who will take Management Level Updating Courses (MLCs) to qualify them on board and to update themselves and comply with the new requirements of the 2010 Manila Amendments to the 1978 International Convention on STCW. This provides financial subsidy amounting to Php 7,500.00 to active OWWA seabased-members who will take up updating MLCs. Other OWWA programs include embarking on a Good Parenting and Anti Child Abuse advocacy campaign and participation to the Workshop of the Special Tripartite Committee on Maritime Labour Convention (MLC) of which the Administrator will be attending. The workshop, which will be held in Geneva on the first week of April 2017, will discuss the proposal of having anti-piracy amendments to the MLC. The Speaker as well granted few questions from the floor to provide better explanation of the report.

On FAME and other industry updates, the FAME Board reported that the Joint Ship Manning Group (JMG) has initiated a strategic plan for overseas and domestic shipping entitled “Maritime Road Map for Blue Philippines” which comprises all sectors in the Philippine maritime industry. Similarly, the Movement for Maritime Philippines (MMP) proposed their own version called “National Maritime Agenda. Both envision establishing a stronger maritime administration and increasing or developing more jobs in the seabased sector. Upon initial dialogue, it was proposed having a summit to further discuss the implementation of both proposals. The issue on the Panama certification was likewise tackled and according to the Panama Consulate, one of the reasons of the delay in the issuance of Panama certificates is the lack of manpower. Upon agreement, JMG donated computer units and will also provide manpower assistance to the Embassy to assist in speeding up applications. The Panama Ambassador then committed to release temporary certificates (CTs) within two (2) working days if all documents are complete and correct. The Panama Embassy likewise ensured issuing same certificate in cases of emergency. The Board also did not hold back in expressing their frustration for the exclusion of the industry’s proposals to the final draft of the POEA Rules and Regulations, which has already been approved by the Governing Board of POEA. FAME nevertheless assured seeking considerations to the POEA on the provisions which are still unacceptable to the maritime sector. A brief updating was also provided to issues concerning the JMG’s position on STC Questionnaire on piracy & robbery, government response on piracy Incidents at Celebes Sea and Sulu Sea, clarification on the applicability of National Heroes Day, US Visa application, implementation of the PDOS for overseas seafarers and the Magna Carta of Filipino Seafarers. The alarming yet real condition of the global shipping industry as well was presented. On another note, the assembly marked FAME’s first increase of membership dues since year 2000.

Adding highlight to the assembly was the awarding of Membership Certificate to new FAME member, Synergygroup Operations Inc. Capt. Joselito Monreal, the company’s CEO and official representative to FAME accepted the certificate.

A total of 101 members and guests attended the 1st FAME annual general assembly for 2017.

11TH FAME INTER-MANNING BADMINTON TOURNAMENT

The hardcourt drama between the finest badminton players in the maritime industry continued in the 11th FAME Inter-Manning Badminton Tournament held at PowerSmash Badminton Court in Makati City last Saturday, 03 September 2016 as around 370 shuttlers (185 pairs) in their respective categories went into a collision course for the most prestigious award of the tourney.

The program started as early as 7:00 a.m. with Mr. Marlon R. Roño, FAME President and Chairman of the Special Projects and Events Committee, opening the ceremony. Ms. Myrna Smith, Accountant and active player from Parola Maritime Corp. and Capt. Dante M. Elpedes, President/General Manager and the team captain of Hoegh Fleet Services Phils. led the invocation and oath of sportsmanship respectively. After the tournament guidelines were explained by the Tournament  Director, Mr. Gary Tulio, the FAME president then requested all Heads of each teams to join him for the ceremonial toss to officially open the tournament.

Temperature immediately filled up the auditorium as soon as the game started signifying an all-out battle throughout the competition.

 The clash between top seeded Randy Robles and Rexon Francisco of Tri-Maritime, Inc. and John Paulo Baluyot and Alex Sia of Smart Communications Inc. in the Level A Men’s Doubles category proved that there’s no easy way to conquest the top title as both teams had to go head to head to win the final game. The team of Tri-Maritime however edged Smart Communications in a close and emotional finish. Same story was witnessed in the Level A of Mixed Doubles category where Gabriel Naval and Kath Del Carmen of Tri-Maritime, Inc. slightly beat Angelico Cerrera and Anne Ortega of BSM Crew Service Centre Phils., Inc. to win the championship. All matchups nonetheless have their own highlights but one thing that was so visible in every match is passion. Passion for badminton, for the team’s victory and fellowship among players.

The 11th FAME Inter-Manning Badminton Tournament was a resounding success and again a showcase of sportsmanship and camaraderie.

10TH FAME FUN RUN

25 June 2016 – the world celebrated the International   Seafarer’s   Day   with   various   activities being held across the globe.  In the Philippines, the Filipino Association for Mariners’ Employment (FAME) took part in the celebration with a kick off Decade Anniversary Run.

This year, FAME completed “Road to History” with 10th FAME “Go Marino Go! Healthy Body, Healthy Mind” Fun Run, a historic feat that has never been achieved in the maritime industry.  

10 years is a long journey, and we’re truly humbled by it. I look back and I realize how far we’ve come. Time has changed. But we’re not close to the finish line yet. We will carry this vision we had 10 years ago to the generations to come. We thanked everyone   who partnered and run with us throughout this milestone. It has been exceptionally fun and rewarding ten years”, Mr.  Marlon R.  Roño, President and Chairman of FAME Special Projects and Events Committee quoted.

The grand assembly,   which   is  also in  participation  to  the  Maritime    Industry  Association’s  (MARINA)  worldwide   celebration  of  the   International   Seafarer’s   Day,   drew  a  wave   of   around   4,400   generationally  divided   runners who covered the entire SM By The Bay of Mall of  Asia green  to  mark  FAME’s Run  for  a  Cause  advocacy to support   the   World   Wildlife    Foundation    (WWF)   Maritime   Environment    Conservation  Program   through  Mangrove Tree  Planting. Mr. Jose Angelito Palma, President and CEO and Mr. Miguel Sison, Corporate Partnership Officer of WWF graced the acceptance of the donation.

One significant  sidelight  to the  Anniversary Run  was the awarding of Hall of FAMErs plaque to  companies that have completed 10 years of participation to the FAME annual event. It was made even more meaningful by the presence  and  a  short message from  some  of  FAME  Officers  and  FAME  Fun  Run  Committee. A representative from WWF-Philippines and a guest wellness & nutrition coach likewise gave informative tips on their respective advocacies. 

The FAME Fun Run decade milestone represents the boundless amount of effort, dedication and vision brought by those who are involved. It reflects moving stories from the thousands of runners   who have decided to take the path to a healthy lifestyle by joining the FAME annual festivity.

With this vision on track, FAME will continue its quest to another decade.

12TH FAME GOLF INVITATIONAL TOURNAMENT

12 May 2016 - The Filipino Association for Mariners’ Employment, Inc. (FAME) went back to the home of Philippine Golf Open Championships, the Wack Wack Golf & Country Club, West Course, located in Mandaluyong City for the 12th installment of its annual golf tournament.

A total of 103 players arrived early all gripped with hope and focused for their awaited sport leisure.

Mr. Marlon R. Roño – President, FAME/Chairman, Special Projects & Events Committee, Mr. Jonathan C. Diokno – Senior Vice President and Head, Remittance Origination, Banco De Oro (BDO) - Over-All Sponsor, Mr. Simon Heo – Member, FAME Special Projects & Events Committee and Capt. Emmanuel L. Regio, Director & Immediate Past President of FAME led the Ceremonial Tee Off. A Gunshot at 0800 hours officially declared the start of the tournament.

It was an intense competition under the pressure of the burning sun but that was the least concern of the hopeful participants. Everyone has their eye on winning the championship, and of course sinking down a hole-in-one which is unfortunately still elusive for 12 years now. But more than the winning and the awards, the occasion was celebrated with camaraderie and sportsmanship.

After hours of exhausting yet exciting contest, Atty. Melchor Dizon of C.S.C Manila, Inc. and Mr. Jae-Sin Sim of Solpia Marine & Ship Management, Inc. dominated the game winning the Low Gross and the Low Net awards respectively.

JMG-FAME partner for 1st Joint General Membership Meeting

The Joint Manning Group (JMG) and the Filipino Association for Mariners’ Employment, Inc. (FAME) partnered for the 1st Joint General Membership Meeting held on 10 March 2016 at the Ballroom of Diamond Hotel, Manila.

The General Assembly not only did tackle the significant issues and developments that are happening in the manning and seafaring industry, it also addressed the future of the industry by inviting the presidentiables of the upcoming national elections to present their agenda for the maritime industry. Unfortunately, among the 5 presidentiables only the tandem of now president-elect Rodrigo Duterte and former Senator Alan Peter Cayetano under PDP-Laban Party was able to attend and present their platforms, which centers on corruption, criminality and drugs. Despite confirming limited familiarity regarding the maritime industry, the tandem pledged to protect the welfare of it as well as its seafarers.

Maritime reelectionist, Angkla Party-List, represented by Capt. Ronaldo SJ. Enrile, likewise presented the legislative agenda they have achieved so far as well as the programs they wish to continue and implement hence sought for support of the general membership to help campaign for them to attain more votes which will strengthen the position of the industry in the congress.

Over 200 participants from the member-companies of JMG including guests attended the General Assembly.
